1. Acceptance of These Terms

By accessing or using The Physics Academy website, creating an account, purchasing a membership, or using any related service, you agree to these Terms of Use and any policies expressly incorporated into them.

If you do not agree with these terms, you must not purchase or use a membership or access restricted membership content.

2. About The Physics Academy

The Physics Academy is an educational support platform providing supplementary physics instruction and learning resources.

The platform may include video lessons, practice homework, unit tests, detailed solutions, exam-review materials, live review sessions, community access, and instructor feedback.

3. Students Under the Age of Majority

Many students using The Physics Academy may be under the age of majority in their province or territory.

If a membership is purchased for a student who has not reached the age of majority, the parent or legal guardian completing the purchase agrees to these terms both personally and on behalf of the student. The parent or legal guardian authorizes the student’s participation in the platform, including its community and live-session features, and is responsible for supervising the student’s use of the services and ensuring the student complies with these terms.

A minor may not create an account, purchase a membership, or use restricted membership services without the authorization of a parent or legal guardian. The Physics Academy may request confirmation of that authorization where reasonably necessary.

4. Educational Purpose

The Physics Academy is intended to supplement a student’s school physics course. It does not replace classroom instruction, professional academic advice, or the requirements established by a student’s school or school board.

The Physics Academy:

• Does not operate as an Ontario secondary school
• Does not issue secondary-school credits, diplomas, or official grades
• Does not guarantee any particular mark, grade, examination result, or academic outcome
• Does not guarantee that every school or teacher will teach course material in the same order or manner

Students remain responsible for following the instructions, expectations, deadlines, and assessment requirements established by their school and teacher.

5. Accounts and Membership Access

You must provide accurate and current information when creating an account or purchasing a membership.

Each membership is intended for one individual student. Account credentials and membership access may not be shared, transferred, resold, or otherwise made available to another person, whether for free or in exchange for payment or anything else of value.

You are responsible for:

• Maintaining the confidentiality of your login information
• Activity conducted through your account
• Notifying The Physics Academy if you suspect unauthorized access
• Ensuring that the information associated with your account remains accurate

6. Memberships, Payments, and Renewals

Prices are displayed in Canadian dollars unless otherwise stated. Applicable taxes may be added during checkout.

Monthly Memberships automatically renew each month until cancelled. Cancel before your next charge is due to prevent future renewals. After cancellation, access continues until the end of the current paid billing period unless that payment is refunded.

A Semester Pass is purchased through a one-time payment, does not automatically renew, and provides access for the period displayed on the applicable product or checkout page.

If a Monthly Membership begins with a free trial, it automatically becomes paid when the trial ends unless cancelled beforehand. The trial length, price after the trial, and billing schedule are shown at signup.

Promotional prices may be offered for a limited time and may be subject to additional conditions disclosed with the promotion.

The initial direct purchase of a Monthly Membership without a free trial or a Semester Pass is eligible for a full refund requested within 24 hours, subject to the Refund and Cancellation Policy. Payments following a free trial and monthly renewal payments are not covered by that guarantee. The Refund and Cancellation Policy sets out the full eligibility requirements, exclusions, and instructions and governs refund and cancellation matters if these terms differ.

7. Permitted Use of Educational Materials

Subject to these terms and an active membership, The Physics Academy grants the enrolled student a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the educational materials solely for the student’s own learning.

Materials that are expressly made downloadable may be downloaded or printed for the enrolled student’s personal educational use. The copying restrictions below do not prohibit this permitted use.

You may not:

• Copy, reproduce, republish, upload, transmit, post, or distribute membership materials, in whole or in part, except as expressly permitted above
• Share, lend, give away, or otherwise make worksheets, tests, solutions, videos, downloads, or account access available to another person
• Screen-record, photograph, capture, record, reproduce, or redistribute video lessons, live sessions, or other protected content
• Sell, resell, license, sublicense, trade, or otherwise commercially exploit any material
• Modify, adapt, translate, repackage, or create derivative materials for redistribution, sale, publication, or use in another educational product or service
• Remove copyright, branding, or ownership notices
• Use automated systems to download, scrape, extract, or reproduce content
• Circumvent or attempt to circumvent download restrictions, access controls, security features, or other content-protection measures
• Use the materials to create, develop, improve, or train a competing product, course, service, database, or artificial-intelligence system

These restrictions apply whether the materials are shared or distributed for free, for payment, through another website or platform, through social media or messaging services, or by any other method.

8. Intellectual Property

Unless otherwise stated, the website, video lessons, questions, tests, homework, solutions, diagrams, graphics, written explanations, branding, and other original materials provided by The Physics Academy are owned by or licensed to The Physics Academy and are protected by applicable intellectual-property laws.

All rights not expressly granted under these terms are reserved by The Physics Academy.

Purchasing a membership or receiving access gives you permission to use the materials only as described in these terms. It does not transfer ownership of any material or grant permission to copy, distribute, publish, sell, resell, or otherwise exploit it.

9. Community Conduct

Students must communicate respectfully and use community features only for appropriate educational purposes.

You may not:

• Harass, threaten, bully, intimidate, exploit, or discriminate against another person
• Post unlawful, abusive, sexually explicit, hateful, violent, or otherwise inappropriate material
• Encourage self-harm, violence, dangerous conduct, or illegal activity
• Impersonate another person or misrepresent your identity, age, or relationship to another person
• Post spam, advertising, malicious links, or harmful software
• Share another person’s private, identifying, or confidential information
• Disrupt a community discussion, live session, or another student’s learning
• Use community features to arrange inappropriate, unsafe, or unauthorized contact

The Physics Academy may moderate, restrict, remove, or preserve community content and may limit a user’s community access when reasonably necessary to protect students, investigate concerns, enforce these terms, preserve evidence, or comply with applicable law.

10. Student Safety and Communication Boundaries

All communication through The Physics Academy must remain professional, respectful, and related to legitimate educational or platform-support purposes.

Users may not:

• Engage in sexual, romantic, suggestive, coercive, manipulative, or exploitative communication
• Request or share intimate, sexual, or otherwise inappropriate photographs, videos, recordings, or messages
• Pressure another user to provide personal contact information, private social-media accounts, photographs, or identifying information
• Encourage another user to move a conversation to a private or disappearing-message service for an inappropriate, unsafe, or non-educational purpose
• Arrange or attempt to arrange an unauthorized in-person meeting
• Engage in grooming, stalking, threats, blackmail, coercion, or other predatory behaviour

Students should not share sensitive personal information, including a home address, personal telephone number, precise location, school schedule, passwords, financial information, or other information that could create a safety or privacy risk.

11. Community Monitoring and Reporting Concerns

The Physics Academy may moderate community activity but does not guarantee continuous or real-time monitoring of every post, message, submission, or interaction.

Students, parents, and legal guardians should promptly report concerning behaviour, content, or communications to The Physics Academy using the contact information provided below. The availability of moderation does not replace appropriate parental or guardian supervision.

The Physics Academy may investigate reported or suspected violations, preserve relevant records, remove content, restrict communication features, and suspend or terminate access where reasonably appropriate.

12. Live Sessions, Privacy, and Recordings

Live sessions are intended for educational purposes. Participants must behave appropriately and follow the instructor’s directions.

If a live session will be recorded by The Physics Academy, reasonable advance notice will be provided and any consent or parent or legal-guardian authorization required by applicable law will be obtained. Depending on how a participant joins or participates, a recording may capture a display name, voice, camera image, screen share, or chat message.

Participants should keep cameras and microphones off when they are not required and must not display private, confidential, or identifying information during a session.

Participants may not photograph, screen-record, audio-record, copy, broadcast, publish, or distribute any live session or any image, voice, name, message, or personal information belonging to another participant.

13. Emergencies and Sensitive Disclosures

The Physics Academy is an educational service. It is not a counselling, medical, mental-health, crisis-intervention, child-protection, or emergency service. The platform must not be used to request emergency assistance.

If a student or another person may be in immediate danger, contact 911 or the appropriate emergency service.

Community posts may be visible to other members. Private support messages and submissions are handled in accordance with the Privacy Policy, but absolute confidentiality cannot be promised. Relevant communications may be reviewed, preserved, or disclosed where permitted or required by law to address safety concerns, investigate misuse, or meet legal obligations.

Where reasonably necessary or legally required, The Physics Academy may contact a parent or legal guardian, the platform provider, emergency services, law enforcement, or a child-protection authority. Nothing in these terms limits any legal duty to report a concern relating to the safety or protection of a child.

14. Questions and Instructor Support

Community or instructor support may be available as part of a membership. The nature, availability, and response time of that support may vary.

Unless a specific response time is expressly stated, The Physics Academy does not guarantee that questions will receive an immediate response or that every submitted question will receive individualized assistance.

Instructor support is educational in nature and is limited to the services described in your membership.

15. Academic Integrity

The Physics Academy is intended to support learning, not academic dishonesty.

Users may not:

• Request or use assistance to cheat on an active test, examination, assignment, or other assessment
• Submit confidential school, teacher, publisher, or third-party materials without authorization
• Upload or distribute an active school test, examination, answer key, or restricted assessment
• Present The Physics Academy’s work or solutions as their own where doing so would violate school rules or academic-integrity requirements
• Use the platform in a manner that violates the rules of a school, teacher, school board, or assessment provider

16. Student-Submitted Content

Students retain ownership of original questions, comments, or other content they submit through the platform.

By submitting content, you give The Physics Academy a limited, non-exclusive permission to store, reproduce, display, review, and use that content only as reasonably necessary to operate the platform, provide support, moderate discussions, investigate concerns, enforce these terms, and deliver the requested services.

You confirm that you own the submitted content or have permission to submit it. You must not submit content that infringes another person’s rights, reveals personal or confidential information without authorization, or contains material you are not authorized to share.

The Physics Academy may remove, restrict, or preserve submitted content when reasonably necessary to address an infringement, privacy, safety, academic-integrity, legal, or terms-of-use concern.

17. Third-Party Services

The Physics Academy uses Thinkific for course delivery and platform features, and Thinkific Payments and its providers for payment processing. Other providers may support video delivery, email, analytics, advertising, or live sessions. Information about personal-data handling is provided in the Privacy Policy.

Your use of certain third-party features may also be subject to the applicable provider’s terms and privacy practices. Third-party services may experience interruptions outside our reasonable control. This does not remove our responsibilities for the services we sell or the personal information we handle.

18. Platform Availability and Changes

The Physics Academy aims to provide reliable access but does not guarantee that the website or every feature will always be available without interruption, delay, or technical error.

Content, features, schedules, and platform organization may be updated when reasonably necessary to improve the service, correct errors, maintain curriculum relevance, address technical requirements, or protect users.

If a material change significantly affects a paid membership, The Physics Academy will take reasonable steps to notify affected members and address any resulting loss of purchased services. This section does not permit us to remove promised paid services without an appropriate resolution.

19. Suspension or Termination of Access

The Physics Academy may suspend, restrict, or terminate access when a user materially violates these terms, shares an account or protected content, copies, records, distributes, sells, or commercially exploits protected content, circumvents content-protection measures, engages in academic dishonesty, creates a safety or privacy concern, disrupts the platform, engages in fraudulent activity, or uses the service unlawfully.

Where appropriate, reasonable notice or an opportunity to correct the issue may be provided. Immediate action may be taken when reasonably necessary to protect students, users, content, systems, evidence, or legal rights.

Suspension or termination does not prevent The Physics Academy from preserving relevant records, reporting a concern where appropriate, or exercising any other rights or remedies available under these terms or applicable law.

20. Disclaimer

The educational materials are provided for general learning and academic-support purposes. Although reasonable efforts are made to provide accurate and helpful content, errors or omissions may occasionally occur.

To the maximum extent permitted by law, the services and materials are provided without guarantees regarding uninterrupted availability, specific academic outcomes, suitability for every student’s individual circumstances, or the conduct of every platform user.

21. Limitation of Liability

To the maximum extent permitted by applicable law, The Physics Academy will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the use of, or inability to use, the platform, community, live sessions, or educational materials.

To the maximum extent permitted by applicable law, The Physics Academy’s aggregate liability for direct damages arising from or relating to the services or these terms will not exceed the total amount paid for the applicable membership during the six months immediately preceding the event giving rise to the claim.

Nothing in these terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.

22. Responsibility for Misuse and Claims

To the extent permitted by applicable law, the account holder and, where applicable, the purchasing parent or legal guardian are responsible for losses, liabilities, claims, or reasonable costs arising directly from their material breach of these terms, unlawful use of the services, infringement of another person’s rights, or submission of content they were not authorized to provide.

This section does not require a user to compensate The Physics Academy for losses caused by The Physics Academy’s own unlawful conduct and does not limit any rights that cannot legally be limited.

23. Privacy

Personal information is handled in accordance with The Physics Academy’s Privacy Policy.

Parents and legal guardians should review the Privacy Policy with minor students. Users should avoid posting sensitive personal information in community areas.

24. Events Outside Reasonable Control

The Physics Academy will not be responsible for a delay or failure caused by circumstances outside its reasonable control, including internet or hosting outages, failures of third-party platforms, natural disasters, severe weather, public emergencies, labour disruptions, cyber incidents, government actions, or other events that could not reasonably be prevented.

25. Changes to These Terms

These Terms of Use may be updated from time to time to reflect changes to the platform, services, business practices, safety requirements, or legal obligations.

The last-updated date will be displayed at the top of this page. Where a change is material, reasonable steps will be taken to notify affected members and obtain any required agreement or consent.

26. Governing Law and Dispute Resolution

These terms are governed by the laws of Ontario and the applicable federal laws of Canada, without limiting any mandatory consumer rights that apply based on a user’s location.

Before starting a formal claim, you are encouraged to contact The Physics Academy so that the concern can be reviewed and an informal resolution can be attempted. Nothing in this section prevents a person from exercising a legal right, contacting a regulator or authority, or seeking urgent relief where necessary.

27. General Provisions

If any provision of these terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

A failure by The Physics Academy to enforce a provision on one occasion does not waive the right to enforce it later.

You may not assign or transfer your membership, account, or rights under these terms. The Physics Academy may assign these terms as part of a lawful transfer or reorganization of the business, subject to applicable law.

These Terms of Use, the Refund and Cancellation Policy, and any additional conditions expressly presented and accepted at purchase govern use of the services. The Privacy Policy explains how personal information is handled.
